These terms govern your use of the WAYPOINT mobile application and related services.
By creating an account, accessing, or using the Service, you agree to these Terms. Please read them carefully before proceeding.
Eligibility
You must be at least 16 years old (as required by applicable law in your region) to use the Service.
If you use the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
The Service
WAYPOINT is a digital self-guided recovery and habit support tool that includes features such as onboarding personalization, check-ins, urge logging, protocols, reminders, and insights.
Important: WAYPOINT is not a medical provider and does not provide medical, psychiatric, or emergency services. If you are in immediate danger or crisis, contact local emergency services immediately.
Account Registration and Security
You may need an account to access parts of the Service. By registering, you agree to:
- Provide accurate and up-to-date information
- Keep your credentials confidential
- Take responsibility for all activity under your account
- Notify us promptly of any suspected unauthorized access
We may suspend or terminate accounts involved in misuse, fraud, or violations of these Terms.
Subscriptions, Billing, and Renewals
Certain features may require a paid subscription.
- Subscriptions are billed through Apple App Store or Google Play
- Billing, renewals, and cancellations are handled by the app store linked to your account
- Subscriptions may auto-renew unless canceled before the renewal date according to store rules
- "Restore purchases" functionality is provided for eligible prior purchases
Refunds
Unless otherwise required by law, refunds are governed by Apple App Store or Google Play policies, depending on where you purchased your subscription.
Acceptable Use
You agree not to:
- Use the Service for unlawful, harmful, or abusive purposes
- Attempt unauthorized access to systems, accounts, or data
- Reverse engineer, decompile, or interfere with the Service
- Circumvent security or access controls
- Use automated means to scrape or misuse the Service
- Upload malicious code or content intended to disrupt operations
Your Content
You may submit content such as check-ins, urge logs, and support messages ("User Content").
- You retain ownership of your User Content
- You grant us a limited license to host, process, store, and display User Content as necessary to operate and improve the Service
- You are responsible for the legality and appropriateness of content you submit
Intellectual Property
The Service, including its software, design, branding, text, graphics, and functionality, is owned by WAYPOINT or its licensors and is protected by intellectual property laws.
Except for rights expressly granted in these Terms, no rights are transferred to you.
Service Availability and Changes
We may modify, update, suspend, or discontinue any part of the Service at any time, with or without notice, to the extent permitted by law.
We do not guarantee uninterrupted or error-free operation of the Service.
Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
WAYPOINT does not guarantee specific outcomes related to recovery, behavior change, or personal progress.
Limitation of Liability
To the maximum extent permitted by law, WAYPOINT and its affiliates, officers, employees, and licensors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, or goodwill arising from your use of the Service.
Where liability cannot be excluded, our aggregate liability is limited to the greater of:
Indemnification
You agree to indemnify and hold harmless WAYPOINT and its affiliates from claims, damages, liabilities, and expenses arising from your misuse of the Service, your violation of these Terms, or your violation of applicable law or third-party rights.
Termination
You may stop using the Service at any time.
We may suspend or terminate your access if you violate these Terms, create risk, or where required for legal or security reasons.
On termination, provisions that by nature should survive — including intellectual property rights, disclaimers, limitation of liability, indemnity, and dispute provisions — remain in full effect.
Changes to Terms
We may update these Terms from time to time. If changes are material, we will provide notice as required by law.
Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
